All student records and family information remain confidential in compliance with Florida regulations.

All staff are mandatory reporters and must follow Florida child protection laws.

6. Professional Boundaries

PEP Hybrid Attendance Policy

Creative Learners Academy requires that all Personalized Education Program (PEP) Hybrid students attend in-person instruction a minimum of two (2) school days per week, in compliance with Florida Department of Education requirements.

Students must be present for the full instructional day on their scheduled campus days unless excused for illness or emergency. Attendance will be documented daily. Failure to meet the minimum two-day in-person attendance requirement may result in non-compliance with PEP Hybrid eligibility requirements.

Parents are responsible for ensuring consistent attendance and timely communication regarding absences.

Reporting Misconduct – Posted Policies 

In accordance with §1006.061(2), F.S., Creative Learners Academy posts the following information in a prominent location accessible to staff and visitors: 

1. Written policies and procedures for reporting misconduct by:

  • Instructional personnel
  • School administrators 
  • Educational support employees 

2. Identification of the contact person to whom reports must be made 

3. A clear statement of penalties for failure to report suspected child abuse, neglect, abandonment, or misconduct

Reporting Misconduct by Instructional Personnel and Administrators

All instructional personnel, educational support employees, and school administrators have an obligation to report misconduct by instructional personnel, educational support employees, and school administrators which affects the health, safety, or welfare of a student.

Examples of misconduct include obscene language, drug and alcohol use, disparaging comments, prejudice or bigotry, sexual innuendo, cheating or testing violations, physical aggression, and accepting or offering favors.

Ethical Standards for Instructional Personnel

Instructional personnel at Creative Learners Academy shall:

Student Protection and Well-Being

  • Make every reasonable effort to protect students from conditions harmful to learning and/or to the student’s mental, emotional, physical health, or safety.
  • Avoid intentionally exposing students to unnecessary embarrassment or disparagement.
  • Respect and protect students’ legal rights.

  • Not unreasonably restrain students from independent action in pursuit of learning.

Training Requirement

Reporting Child Abuse, Abandonment, or Neglect

All employees and agents of Creative Learners Academy have an affirmative duty to report all actual or suspected cases of child abuse, abandonment, or neglect.

Signs of Physical Abuse

A child may have:

  • Unexplained bruises, welts, cuts, burns, or broken bones
  • Fear of going home
  • Aggressive or withdrawn behavior
  • Fear of physical contact
  • Clothing used to hide injuries

Signs of Sexual Abuse

A child may display:

  • Difficulty walking or sitting
  • Torn, stained, or bloody undergarments
  • Knowledge of sexual behavior inappropriate for age
  • Sudden fear of a particular person
  • Withdrawal, depression, or sudden behavioral changes

Signs of Neglect

A child may exhibit:

  • Unattended medical needs
  • Poor hygiene
  • Inadequate supervision
  • Frequent hunger or fatigue
  • Significant weight loss or appearing underweight
  • Excessive need for adult attention

A single sign may not necessarily indicate abuse, but a pattern of physical or behavioral indicators should always be taken seriously and reported immediately.

Liability Protections

Any person, official, or institution participating in good faith in reporting suspected child abuse, abandonment, or neglect to the appropriate authorities is immune from civil or criminal liability under Florida law (F.S. 39.203).

An employer who discloses information about a former or current employee to a prospective employer upon request is immune from civil liability for such disclosure unless it is shown by clear and convincing evidence that the information disclosed was knowingly false or violated the employee’s civil rights under Florida law (F.S. 768.095).

Instructional Personnel Qualifications
All instructional personnel employed by Creative Learners Academy holds one of the following:

  • Bachelor's Degree or higher in any subject (copy of diploma or completed transcript)
  • Three or more years of K-12th grade teaching experience (written proof of contacting the previous employer)
  • Special skills, knowledge, or expertise that qualifies them to provide instruction in K-12 grade subjects (provide documentation such as certifications, professional development, curriculum training, etc.). Pre-K experience and certifications would not meet this requirement.
